It does however have some strong language about the direct funding of religious organizations and instruction (due to the large and in charge LDS population in Utah when it was applying for state hood, Congress wanted to make sure that the new state of Utah wasn&#039;t going to directly fund the LDS Church).

Despite this language, there are many experts that are confident that it will pass constitutional muster, partly for the very reasons you listed above.
